This memorandum contains reports on two cases of companies violating the eight hour work day law. The first case, in West Virginia, did not result in indictments and so the case was moved to Ohio. The second case was along the Columbia River in Oregon.

Attorney General Bonaparte reports to President Roosevelt that Robert T. Devlin, U. S. Attorney, will be headed east as soon as he can get on a train. Bonaparte will not come to Washington until Wednesday, assuming Roosevelt does not need him before then to discuss United States v. Wickersham (201 U.S. 390) and the pay increase for the warden of the federal prison reservation in Atlanta, Georgia.

President Roosevelt has received Attorney General Bonaparte’s letter and invites him to visit in Oyster Bay, New York, when convenient. While Roosevelt had hoped to “avoid the muss” regarding the case of Ulysses S. Bratton, Assistant United States Attorney for Arkansas, he agrees with Bonaparte on the matter. Roosevelt will discuss the Connecticut judgeship with Bonaparte at a later time.

Attorney General Bonaparte relays his tentative conclusions to President Roosevelt regarding several potential appointees to permanent federal marshal, attorney, and judiciary positions in the “embryonic State” of Oklahoma (which became a state on November 16, 1907).

Cecil Andrew Lyon, chairman of the Texas Republican Committee, informs President Roosevelt that the party may wish to nominate for governor J. W. Ownby, the U.S. Attorney of Texas’s Eastern District. Lyon feels Ownby is a strong candidate due to his prestige, oratorical skill, and unique status as a former Democrat. As the nomination would impact the U.S. attorney’s office, however, Lyon wants Roosevelt’s input. Lyon has followed Roosevelt’s suggestion in asking Secretary of War William H. Taft to speak at the Republican state convention in El Paso on August 14, but should Taft decline, he intends to invite Secretary of the Treasury Leslie M. Shaw.
