President Roosevelt agrees with Attorney General Bonaparte in not interfering on behalf of Eugene A. Tucker, but that his lawyer should be punished. He believes that former Illinois Governor Richard Yates could be employed in the powder trust case. In a postscript, Roosevelt discusses how state and local governments use extralegal measures to combat non-governmental entities.

President Roosevelt informs Senator Burkett that he is not inclined to make another outside appointment to the Arizona judgeship, and instead would like to appoint men from Arizona wherever possible. He made an exception to this rule when he had to remove Judge Eugene A. Tucker, and does not want to do so again to avoid offending Arizonians.

Letter from Theodore Roosevelt to Ethan Allen Hitchcock

President Roosevelt is concerned over statements in a memorandum by Secretary of the Interior Hitchcock. Hitchcock seems to imply that there are Senate-appointed men in the civil service who are unfit to hold their positions and do not follow the rules of the departments they work in, who cannot be removed by the Executive for proper cause. Roosevelt tells Hitchcock that this is not the case, and that placing these positions under the classified service would not allow for the hiring of better men than the current appointment system allows.
