Similar to the land fraud prosecutions in Oregon and Montana, Benjamin H. Tallmadge, of the C. L. Tallmadge Southwestern Land Company, has been arrested on the charge of subornation of perjury. It is the first of many prosecutions that will be brought for alleged fraud in land entries and deals in New Mexico. Tallmadge maintains his innocence.

President Roosevelt warns Major William H. H. Llewellyn, Attorney General of New Mexico Territory, that in Washington there’s a perception that he’s “lukewarm” in his prosecution of land fraud cases. Roosevelt asks why Benjamin H. Tallmadge was released.

James Sullivan Clarkson asks William Loeb to do what he can to allow his son Grosvenor B. Clarkson’s testimony in the land fraud trial of Benjamin H. Tallmage to be taken in New York rather than New Mexico, where the trial is being held. Grosvener had been severely beaten in the process of the investigation and has still not recovered. Clarkson fears the journey will reverse any improvements he had made and asks Loeb as a fellow father to use his influence to prevent it.
