President Roosevelt informs California Governor Gillett that he does not want to appoint Charles E. Thomas as postmaster of Berkeley, California, in light of the opposition to him. Instead, Roosevelt plans to appoint Clarence S. Merrill because Representative Knowland says he is a good man and the only objection to Merrill is that the postmastership had been promised to Thomas.

President Roosevelt saw Senator Frank P. Flint, who has been very helpful, after receiving Governor Gillett’s message. On Flint’s advice, Roosevelt sent a telegram to Speaker Philip A. Stanton of the California State Assembly that Stanton may publish. Roosevelt asks Gillett to see Stanton. He approves of Gillet’s course of action, and will happily offer additional assistance if Gillett thinks he could be useful.

President Roosevelt sends California Governor Gillett a copy of the memorandum by Secretary of State Elihu Root concerning alien real property legislation in California. Roosevelt notes that the United States Government has no objection to California passing laws regarding aliens’ ability to own real property as long as the laws follow Root’s suggestions. However, the federal government would object to passing the proposed school legislation and proposed legislation forcing Japanese to live in separate residential quarters.

Roosevelt believes that the passing of this legislation is unnecessary and will injure relations with Japan, considering the Japanese government has upheld the Gentlemen’s Agreement of 1907.
