Bristol, and that after conferring with several cabinet secretaries he has come to the conclusion that he could be justified in resubmitting Bristol’s name for confirmation, as he seems to be cleared of guilt.

President Roosevelt tells Senator Fulton that reports of friction between the two of them are “entirely incorrect.” As Senator from Oregon, Fulton will have “all proper consideration” from Roosevelt, regarding appointments and other matters. The only exceptions have been in “peculiar conditions” regarding offices under the Department of Justice and Department of the Interior, where Roosevelt has felt that he has to act on his own responsibility.

President Roosevelt encloses a report made my U.S. Attorney Francis J. Heney which alleges that Senator Fulton and Senator John H. Mitchell recommended George C. Brownell for District Attorney knowing that he was guilty of fraudulent conduct. They made other recommendations for appointments knowing that John Hicklin Hall, a potential appointee, would not prosecute Brownell for criminal misconduct if he were appointed. In light of these revelations, Roosevelt will appoint Charles E. Wolverton as District Judge of Oregon.
